MINUTE entry before the Honorable John Robert Blakey: The Court denies without prejudice Plaintiff's motion for entry of a temporary restraining order 6 because Plaintiff failed to comply with this Court's standing orders, which require, among other things, that all motions be noticed for presentment and that all substantive motions be accompanied by a proposed order submitted to this Court's proposed order inbox. If Plaintiff wishes to pursue this matter, it must strictly comply with this Court's rules. Additionally, as pled, Plaintiff's complaint does not provide a basis to join the 60 identified Defendants in this single action. Joinder of multiple defendants in a single copyright infringement action remains appropriate only if the claims against the defendants are asserted "with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences," and a common question of law or fact exists as to all defendants. Fed. R. Civ. P. 20(a)(2)(A)-(B). In this regard, Plaintiff alleges that joinder "is permitted because Sharp Shirter asserts rights to relief against these Defendants jointly, severally, or in the alternative with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences; and common questions of law or fact will arise in the action." 4 at 29. But this is a legal conclusion, which the Court need not accept. Plaintiff also alleges that the Defendants operate in the same manner, which suggests they are "logically related." Id. 35-38. But the one does not necessarily follow the other; it is equally possible that each online retailer set up shop in the same or similar manner. See, e.g., Estee Lauder Cosms. Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, 334 F.R.D. 182, 188-89 (N.D. Ill. 2020). To the extent Plaintiff can, consistent with its obligations under Rule 11, amend its complaint to allege facts to support the joinder of 60 Defendants in this single action, it may do so by 6/7/24. MINUTE entry before the Honorable John Robert Blakey: This Court previously dismissed Plaintiff's complaint, which named 60 Defendants, because the complaint failed to allege facts to support the joinder of all Defendants in this single action. See 10. In response, Plaintiff filed an amended complaint, which names 99 Defendants. Plaintiff alleges that all 99 Defendants are "subject to personal jurisdiction in this district because each Defendant directly targets consumers in the United States, including in Illinois, through at least the fully interactive commercial Internet stores operating under the Defendant domain names and/or the Online Marketplace Accounts identified in Schedule A attached hereto." 11 6. Plaintiff purports to support this allegation with screenshot evidence showing that each named Defendant stands ready, willing, and able to ship infringing products to residents of Illinois. But the screenshots attached to the complaint fail to provide any basis to exercise personal jurisdiction over Defendant numbers 1, 3, 9, 11, 16, 40, 57, 77, 80 through 84, and 86 through 99. [12-2]. Accordingly, the Court denies the motion for temporary restraining order, and dismisses the complaint as to these Defendants for lack of personal jurisdiction. The Court finds that the amended complaint does support the joinder of the remaining Defendants in this single action. For example, the amended complaint alleges that the Defendants "employ no normal business nomenclature and, instead, have the appearance of being made up, or if a company that appears to be legitimate is used, online research shows that there is no known address for the company," thus the Defendants "are using fake online storefronts designed to appear to be selling genuine copies of Plaintiff's Subject Artwork, while selling inferior imitations of Plaintiffs' Subject Artwork"; the Defendants "share unique identifiers, such as design elements, SEO tactics like keyword stuffing, and similarities of the counterfeit products offered for sale, establishing a logical relationship between them and suggesting that Defendants' illegal operations arise out of the same transaction, occurrence, or series of transactions or occurrences," and that "Defendants are engaging in the same systematic approach of establishing online storefronts to redistribute illegal products from the same or similar sources while maintaining financial accounts that the Defendants can easily conceal to avoid any real liability for their actions;" that Defendants "are engaging in the same infringing activities, i.e., displaying and offering Infringing Products for sale on Amazon.com, at the same time and therefore are undeniably involved in the same series of transactions or occurrences giving rise to this claim at the same time." 11 29, 36, 37. And Plaintiff includes screenshot evidence showing that each Defendant has actually offered infringing products for sale. See [12-2]. Finally, Plaintiff alleges that "based on the Infringing Products quality and similarities in printing, Plaintiff has reason to believe that the products are sourced from the same vendor, manufacturer, or printing facility. Additionally, the sellers identified in Schedule A self-identify its location either in the same city in China or cities within close proximity to each other. Further, the product listings feature the same photographs and advertisements, further supporting that all Defendants named in Schedule A obtain the Infringing Products from a common source." Id. 38. The Court finds that such allegations satisfy Fed. R. Civ. P. 20(a)(2)(A)-(B), and, based upon the allegations in the amended complaint, the Court will allow Plaintiff to proceed as to Defendants 2, 4-8, 10, 12-15, 17-39, 41-56, 58-76, 78-79, and 85. Plaintiff may renew its motion for temporary restraining order as to these Defendants and submit a revised proposed order by 6/17/24. The Court denies the current TRO motion 15 and strikes the 6/12/24 Notice of Motion date. The Court grants the motion to seal 14. Mailed notice

MINUTE entry before the Honorable John Robert Blakey: On 6/7/24, Plaintiff filed an amended complaint against numerous Defendants alleging copyright infringement. See 11. On Plaintiff's motion, and based upon the record before it, on 6/24/24, this Court entered a temporary restraining order against several Defendants, including YZSM (Defendant No. 14). YZSM subsequently moved to dismiss Plaintiff's complaint, arguing that Plaintiff's allegations (specifically, Plaintiff's "shotgun pleading" and incorporation of allegations by reference) fail to state a claim, 67. Plaintiff responded to the motion as ordered, 81, and, based upon the record, the Court now denies YZSM's motion 67. The motion consists of five paragraphs and includes just one argument, asserting in a single sentence: "Plaintiff incorporated in each count all the previously alleged paragraphs, not only constituting a shotgun pleading, but also failing to state a cause of claim for relief, as Defendant is not aware which element belongs to which count and how to frame a response to the complaint." 67 at 2. The argument remains facially inadequate and belied by the complaint and the materials submitted in support of the TRO motion, which contain adequate factual detail for the defendants to understand the claims against them.
