Plaintiff argues that Botrong Defendants' Answer [79] fails to comply with Local Rule 10.1's formatting requirement and to present a "short and plain statement" of its affirmative defenses as required by Federal Rule of Civil Procedure 8(b). Fed. R. Civ. P. 8(b). First, Local Rule 10.1 holds that "[r]esponsive pleadings shall be made in numbered paragraphs each corresponding to and stating a concise summary of the paragraph to which it is directed." L.R. ND. IL. 10.1. "That requirement has as its obvious goal the enablement of readers (principally opposing counsel and the judge) to see just what allegations are or are not being placed in issue without having to flip back and forth between two separate pleadings." Deutsche Bank Nat. Tr. Co. v. Dionicio, No. 13 C 521, 2013 WL 1282785, at *1 (N.D. Ill. Mar. 27, 2013). Here, as Plaintiff notes, Defendants simply indicate whether they admit or deny an allegation next to a number that presumably represents a paragraph in the Complaint. This format is a complete apostate to the Local Rules and do not aid in the ease of identifying allegations at issue. Therefore, the Court, in its discretion, finds that Defendants' failure to comply with LR 10.1 is grounds to grant Plaintiff's motion to strike. Next, under Federal Rule of Civil Procedure 12(f), a district court, in its discretion may "strike from a pleading an insufficient defense or any redundant, immaterial, impertinent, or scandalous matter." And "[m]otions to strike are disfavored because they potentially serve only to delay." Allgood v. CNA Int'l, Inc., 2024 WL 1530466, at *1 (N.D. Ill. Apr. 9, 2024) (citing Heller Fin., Inc. v. Midwhey Powder Co., 883 F.2d 1286, 1294 (7th Cir. 1989) (citation omitted)). However, motions to strike may serve to "remove unnecessary clutter from the case, in which case they serve to expedite, not delay." Id. A motion to strike affirmative defenses will be granted "only when they are insufficient on the face of the pleadings," so as they "will not be struck if they are sufficient as a matter of law or present questions of law or fact." Id. Thus, to survive a motion to strike, "(1) the matter must be properly pleaded as an affirmative defense; (2) the matter must be adequately pleaded under the requirements of Federal Rules of Civil Procedure 8 and 9; and (3) the matter must withstand a Rule 12(b)(6) challenge." Romans v. Orange Pelican, 2023 WL 2933050, at *3 (N.D. Ill. Apr. 13, 2023). The Court agrees with the Plaintiff here. "Affirmative defenses are pleadings and, therefore, are subject to all pleading requirements of the Federal Rules of Civil Procedure." Bobbitt v. Victorian House, Inc., 532 F.Supp. 734, 73637 (N.D.Ill.1982). To state an affirmative defense, like in a complaint, a party is required to "state in short and plain terms its defenses to each claim asserted against it." Fed. R. Civ. P. 8(b)(1)(A). Defendants have failed to provide a sufficient defense. The fair use affirmative defense argued by Defendants' is only one line ("Defendants used the trademark in its primary, descriptive sense rather than as a source identifier."), the standard requires a bit more. Because "[d]efenses are pleadings, and as such, leave to amend is freely granted as justice requires." Heller Fin., Inc. v. Midwhey Powder Co., 883 F.2d 1286, 1294 (7th Cir. 1989); see also Fed.R.Civ.P. 15(a). The Court grants Defendants leave to file an amended answer.
