MINUTE entry before the Honorable John Robert Blakey: In this patent infringement case, Plaintiff seeks to join 154 defendants in a single suit. Under 35 U.S.C. § 299, "parties that are accused infringers may be joined in one action as defendants. only if-- (1) any right to relief is asserted against the parties jointly, severally, or in the alternative with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences relating to the making, using, importing into the United States, offering for sale, or selling of the same accused product or process; and (2) questions of fact common to all defendants or counterclaim defendants will arise in the action. Id. § 299(a). The statute specifically provides that "accused infringers may not be joined in one action as defendants. based solely on allegations that they each have infringed the patent or patents in suit." Id. § 299(b). Plaintiff's complaint, which lumps all Defendants together, alleges on information and belief that "Defendants are an interrelated group of infringers working in active concert to knowingly and willfully make, use, offer for sale, sell, and/or import into the United States for subsequent sale or use products that infringe directly and/or indirectly the Patent in the same transaction, occurrence, or series of transactions or occurrences. For example, Defendants all sell and/or offer for sale the same infringing products with minor variations as well as similar if not identical product images and descriptions as shown in Exhibit 1." 5 10. But a cursory review of the exhibits attached to the complaint suggests otherwise. Plaintiff submitted a copy of the asserted patent, which consists of a single claim and eight figures depicting a cosmetic bag with a double zipper running across the top side with the handle and then diagonally down the sides of the bag. See [7-7]. Although some of the screenshot evidence shows bags that are obviously similar in design, much of it does not. For example, some of the screenshot evidence shows bags whose handles are adorned with rivets or buckles, neither of which are present in the patent drawing sheets. See, e.g., [7-3] at 3, 8, 36, 83, 127, 131, 156; [7-4] at 98, 106, 111, 119, 123, 131, 135, 139, 144, 159, 163, 167. Other screenshot evidence shows bags with zippers dissimilar to those in the drawing sheets. See, e.g., [7-3] at 3, 24, 36, 52, 87; [7-4] at 123, 139, 167; [7-5] at 18. Other screenshots show dissimilar bag patterns or markings. See, e.g., [7-3] at 32, 71; [7-4] at 127, 144; [7-5] at 67. One shows a handle looping off the side, rather than affixed at both ends on the top. [7-5] at 63. Such variations undermine Plaintiff's allegations in support of joinder. They also undermine Plaintiff's claimed likelihood of success on the merits. A design patent is infringed "if, in the eye of an ordinary observer, giving such attention as a purchaser usually gives, two designs are substantially the same, if the resemblance is such as to deceive such an observer, inducing him to purchase one supposing it to be the other." Ethicon Endo-Surgery, Inc. v. Covidien, Inc., 796 F.3d 1312, 1335 (Fed. Cir. 2015) (citing Egyptian Goddess, Inc. v. Swisa, Inc., 543 F.3d 665, 670 (Fed.Cir. 2008)). "As with utility patents, the patentee must prove infringement of a design patent by a preponderance of the evidence," and "where the claimed and accused designs are 'sufficiently distinct' and 'plainly dissimilar,' the patentee fails to meet its burden of proving infringement as a matter of law." Id. (quoting Egyptian Goddess, 543 F.3d at 678-79). Here, that is the case with respect to many of the allegedly infringing products. As a result, the Court denies the motion for TRO and dismisses the complaint 5. To the extent Plaintiff can, consistent with its obligations under Rule 11, amend its complaint to cure the deficiencies noted here, it may file an amended complaint by 7/2/24. If Plaintiff proceeds, counsel must first file an updated appearance form that establishes compliance with the Local Rules. In particular, Local Rule 83.12 provides that "only members in good standing of the general bar of this Court may enter an appearance on behalf of a party; file pleadings, motions or other documents; sign stipulations; or receive payments upon judgments, decrees or orders." MINUTE entry before the Honorable John Robert Blakey: Having reviewed Plaintiff's second amended complaint 15, which claims patent infringement against 51 separate Defendants, 15, the Court finds that the complaint may not proceed as to certain Defendants. The documents attached to the complaint undermine Plaintiff's claim of infringement as to Defendant No. 12, as the allegedly infringing product has an attached handle, which is not present in the patented design. See [21-3] at 49. Additionally, the screenshot evidence fails to support the personal jurisdiction allegations as to Defendants 20, 21, 25, 31, 40, 41, 42, 43, and 48. See [21-4] at 3; [21-4] at 7, 22, 47; [21-5] at 19-21, 23-25, 27, 31; [21-6] at 15. Accordingly, the Court dismisses this case as to Defendants 12, 20, 21, 25, 31, 40, 41, 42, 43, and 48. Plaintiff may proceed on its complaint as to the remaining Defendants (Nos. 1-11, 13-19, 22-24, 26-30, 32-39, 44-47, and 49-51), and the Court finds, based upon Plaintiff's allegations, that joinder of these Defendants in a single action remains proper. For example, Plaintiff alleges that the Defendant Internet Stores "share unique identifiers, such as using the same product images, same advertising, design elements and similarities of the infringing products offered for sale, indicating the products originate from the same Chinese factory"; that "Defendants all sell and/or offer for sale the same infringing products with minor variations as well as similar if not identical product images and descriptions as shown in Exhibit 1"; that the "infringing products are nearly identical and appear to originate from the same Chinese factory"; and that defendants' stores "include notable common features beyond selling the exact same infringing product, including the same product images, the accepted payment methods, check-out methods, lack of contact information, identically or similarly priced items, and the use of the same text and images." 15 2, 11, 12, 15. For present purposes, such allegations satisfy the "series of transactions or occurrences" requirement of § 299(a)(1), as well as Fed. R. Civ. P. 20(a)(2), and Plaintiff may proceed against Defendants 1-11, 13-19, 22-24, 26-30, 32-39, 44-47, and 49-51 in this single action.
