A district court may grant a certification for interlocutory appeal where: (1) the order involves a question of law; (2) the issue is contestable; (3) the issue is controlling; (4) immediate appeal of the issue would materially advance the ultimate termination of the litigation; and (5) the petition to certify is brought within a reasonable amount of time after entry of the order sought to be appealed. 28 U.S.C. § 1292(b); Richardson Elecs., Ltd. v. Panache Broad. of Pa., Inc., 202 F.3d 957, 958 (7th Cir. 2000). All of these criteria must be met for a certification to be issued. Ahrenholz v. Bd. of Trs. of the Univ. of Ill., 219 F.3d 674, 676 (7th Cir. 2000). District courts have discretion when considering whether to allow interlocutory appeals. Swint v. Chambers Cnty. Comm'n, 514 U.S. 35, 47 (1995). The Court finds Defendants' petition to certify untimely. The order Defendants seek to appeal [150] was issued 11/18/2024, Defendants filed their notice of cross-appeal on 12/18/2024 [176], and the present motion was filed 1/9/2025. As justification, Defendants contend the holidays and counsel's litigation schedule caused the delay. R. 196 at 2. First, this is not a sufficient justification for a two-month delay. Second, the timing is suspect, with this motion coming only after Defendants filed their notice of appeal and the Seventh Circuit sought briefing on its jurisdiction. In any event, briefing on the Seventh Circuit's jurisdiction is already underway and the arguments Defendants advance before the Seventh Circuit largely mirror their arguments before this Court. See Case Nos. 24-3269, Dkt. 18, & 24-3307, Dkt. 5 (7th Cir.). Entertaining the request for certification at this point would be superfluous. For these reasons, Defendants' motion [188] is denied.
