199

Jan. 31, 2025

MINUTE entry before the Honorable Thomas M. Durkin: For the following reasons, the Ambirenton Defendants' motion to certify issues for appeal [188] is denied. A district court may grant a certification for interlocutory appeal where: (1) the order involves a question of law; (2) the issue is contestable; (3) the issue is controlling; (4) immediate appeal of the issue would materially advance the ultimate termination of the litigation; and (5) the petition to certify is brought within a reasonable amount of time after entry of the order sought to be appealed. 28 U.S.C. § 1292(b); Richardson Elecs., Ltd. v. Panache Broad. of Pa., Inc., 202 F.3d 957, 958 (7th Cir. 2000). All of these criteria must be met for a certification to be issued. Ahrenholz v. Bd. of Trs. of the Univ. of Ill., 219 F.3d 674, 676 (7th Cir. 2000). District courts have discretion when considering whether to allow interlocutory appeals. Swint v. Chambers Cnty. Comm'n, 514 U.S. 35, 47 (1995). The Court finds Defendants' petition to certify untimely. The order Defendants seek to appeal [150] was issued 11/18/2024, Defendants filed their notice of cross-appeal on 12/18/2024 [176], and the present motion was filed 1/9/2025. As justification, Defendants contend the holidays and counsel's litigation schedule caused the delay. R. 196 at 2. First, this is not a sufficient justification for a two-month delay. Second, the timing is suspect, with this motion coming only after Defendants filed their notice of appeal and the Seventh Circuit sought briefing on its jurisdiction. In any event, briefing on the Seventh Circuit's jurisdiction is already underway and the arguments Defendants advance before the Seventh Circuit largely mirror their arguments before this Court. See Case Nos. 24-3269, Dkt. 18, & 24-3307, Dkt. 5 (7th Cir.). Entertaining the request for certification at this point would be superfluous. For these reasons, Defendants' motion [188] is denied. Mailed notice.

NOTICE of Voluntary Dismissal by All Plaintiffs as to [Certain] defendants

205

March 6, 2025

MINUTE entry before the Honorable Beth W. Jantz: The Court has received settlement position statements from Plaintiff, Defendant halcfg.com, and Defendant group ambirenton.com. Upon review, Defendant group ambirenton.com did not comply with this Court's minute order [200] or Standing Order for Settlement Conferences because it did not provide an updated offer to Plaintiff. Therefore, if Defendant group ambirenton.com wishes to continue to pursue a settlement conference with Plaintiff, it must submit an updated offer to the Court's settlement inbox (Settlement_Correspondence_Jantz@ilnd.uscourts.gov) and to opposing counsel by 3/13/25. This same Defendant also failed to comply with this Court's 5-page limit for its position statement. [200] Additionally, Plaintiff did not comply with this Court's minute order [200] or Standing Order as to Defendant halcfg.com because it actually increased its demand from its last position. If Plaintiff wishes to continue to pursue a settlement conference with Defendant halcfg.com, it must submit an updated demand (which must be lower than the offer it made before the recent position statement) to the Court's settlement inbox (Settlement_Correspondence_Jantz@ilnd.uscourts.gov) and to opposing counsel by 3/13/25. The 3/21/25 status hearing stands. Mailed notice.

Co.) is a party in Case No. 24-cv-00596, and that Plaintiff is prepared to dismiss Defendant No. 32 from this case when the court in that parallel case grants the motion to substitute parties that is pending there. Plaintiff and Defendant Nos. 4 (Larryhot), 11 (Sonzea), 24 (Ruoxing), and 41 (Banbain Trade Co.) agree to submit blind negotiating brackets, as discussed on the call. MINUTE entry before the Honorable Beth W. Jantz: Status hearing on settlement held on 4/8/25, so that the parties can report on settlement negotiations just with respect to Defendant No. 40 (halcfg.com). The Court makes a mediator's recommendation, and each side shall confer with their respective clients on said recommendation. 216

May 12, 2025

MINUTE entry before the Honorable Beth W. Jantz: The status hearing on settlement as between Plaintiff and Defendant No. 40 (halcfg.com) remains set for 5/14/25, unless those parties file their dismissal papers with the District Judge before then. Plaintiff and Defendant Nos. 4 (Larryhot), 11 (Sonzea), 24 (Ruoxing), and 41 (Banbain Trade Co.) have previously submitted blind negotiating brackets for the Court's review, but the Court believes that the parties are still too far apart for further Court-assisted settlement talks to be fruitful at this time. So Plaintiff and those remaining Defendants are returned to the District Judge unless the District Court advises that Judge Jantz should also handle discovery as to those remaining Defendants. The Court notes that a 7th Circuit mediation appears to be scheduled for May 22, 2025, and thus briefing in the interlocutory appeal is suspended pending the outcome of that mediation.
