MINUTE entry before the Honorable John F. Kness: Before the Court is Plaintiff's motion 107 seeking leave for its new counsel to appear remotely at the 6/12/2025 motion hearing. Also pending are several other motions that will be addressed by this order. As to the motion for leave, plaintiffs who elect to litigate in this District and then elect to hire lawyers who do not have offices in this District should not be surprised when their lawyers are then made to appear in person for hearings in this District. Remote hearings are a privilege, not a right, and there are many reasons that a judge might have to hold a hearing in person. When an in-person hearing is set, parties and lawyers need to accept the need to appear in person just as if we were in the pre-Covid days of yore. In this instance, however, the substantive relief sought by Plaintiff is such that an in-person hearing is not strictly necessary; in fact, a hearing is not needed at all on the motion for leave to substitute counsel. Accordingly, the motion to substitute counsel 104 is granted. John Choi is substituted as lead counsel for Plaintiff, and Nicholas Lee is withdrawn as counsel. The motion hearing set for 6/12/2025 is stricken, and the motion for leave to appear remotely 107 is dismissed as moot. In that motion, Plaintiff's new counsel represented that Plaintiff "has requested that [counsel's] firm file motions for default judgment against remaining defendants that have not appeared, and to conclude the case thereafter." (Dkt. 107 at 1.) In view of that representation, the motion for a preliminary injunction 32 is dismissed as moot. Plaintiff's motion for reconsideration 72 is denied for the reasons previously provided on the record. (See Dkt. 71.) Any request to revisit these latter issues will require an in-person appearance by Plaintiff's counsel. Mailed notice.

Shortly after that motion was filed, Guoen Yuan, a person purporting to represent Def. 71, contacted the Court by email regarding this case. The Clerk is directed to place that email on the docket, and Guoen Yuan is directed to communicate with the Court only through filings on the docket. A telephonic hearing is set for 7/8/2025 at 9:30 A.M. Plaintiff's lead counsel and Guoen Yuan and directed to appear by telephone at that hearing. All remaining Defendants (including Def. 71) have not timely appeared to defend against this action; accordingly, the Clerk is directed to enter default against all remaining Defendants. Plaintiff's motion for default judgment will be held in abeyance until the case against Def. 71 is resolved. If Plaintiff opts to dismiss Def. 71 in advance of the upcoming hearing, the Court will promptly adjudicate the motion for default judgment.
