86

Sept. 27, 2024

MINUTE entry before the Honorable Sara L. Ellis: The Court denies Defendant Kenes' motion to vacate [35] as moot in light of Plaintiff's notice of voluntary dismissal as to Defendant No. 6 [55]. The Court deems Defendant Ceinol-USA's opposition to the motion for entry of a preliminary injunction [27] moot in light of Plaintiff's notice of voluntary dismissal as to Defendant No. 11 [54]. The Court grants Defendant FORIOUS' motion to modify the temporary restraining order bond amount [57]. A "court may issue a preliminary injunction or a temporary restraining order only if the movant gives security in an amount that the court considers proper to pay the costs and damages sustained by any party found to have been wrongfully enjoined or restrained." Fed. R. Civ. P. 65(c). "The appropriate amount of the bond is subject to the court's discretion." Monster Energy Co. v. Wensheng, 136 F. Supp. 3d 897, 910 (N.D. Ill. 2015). "[W]hen setting the amount of security, district courts should err on the high side." Mead Johnson & Co. v. Abbott Lab'ys, 201 F.3d 883, 888 (7th Cir. 2000). In this case, the Court initially required a $10,000 bond. Having reviewed Plaintiff's and FORIOUS' arguments concerning the proper bond amount, the Court finds it appropriate to increase the bond amount in this case to $320,000, which takes into account the number of defendants Plaintiff initially sued and the potential damages they may have incurred under the temporary restraining order and preliminary injunction in this case. The Court thus orders Plaintiff to deposit with the Court an additional $310,000, either cash or security bond, as security within seven (7) calendar days of this order. The Court also notes that Plaintiff failed to respond to Defendants BATHLAVISH, BWE Aqua Faucet, Bathfinesse Faucet, Greenspring, VIBRANTBATH, BESy Bathroom & Kitchen, BESy, HOIMPRO, and RUMOSE's motion to vacate the preliminary injunction order [48]. To the extent Plaintiff wishes to file a response, Plaintiff should do so by 10/2/2024. Defendants can file a reply by 10/9/24 if they wish. The Court strikes the status dates set for 10/1/2024 and 10/8/2024 and resets them to 10/16/2024 at 9:30 a.m. for ruling on the remaining outstanding motions. Mailed notice

April 8, 2025

MINUTE entry before the Honorable Maria Valdez: Remote attorneys-only settlement conference is set for 4/24/25 at 11:00 a.m. Participating counsel will be sent a Webex link, and they shall advise chambers as soon as possible if their contact information changes before the conference. Final settlement positions are due by 4/22/25. Failure to comply with the provisions of the Court's Standing Order may result in the unilateral cancellation of the settlement conference by the Court. THE FACT THAT A SETTLEMENT CONFERENCE HAS BEEN SCHEDULED DOES NOT MEAN THAT THE PARTIES SHOULD STOP ENGAGING IN SETTLEMENT DISCUSSIONS AMONG THEMSELVES. The Court finds that too often the parties put settlement talks on hold until the settlement conference with the Magistrate Judge. The Court expects that many cases can be resolved among the parties without the need for court-supervised mediation. If your informal discussions are unsuccessful, the Court will conduct the conference but will expect the parties to apprise her of the status of their ongoing settlement discussions. Because of the volume of settlement conferences conducted by Judge Valdez, once a settlement conference date has been agreed upon, no continuance will be granted without a motion showing extreme hardship.
