MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's motion for TRO 8 is denied without prejudice. Under ABC Corp. I v. Partn. and Unincorporated Associations Identified on Sched. "A", 52 F.4th 934 (Fed. Cir. 2022), the Court is "required to conduct the ordinary observer test through the lens of the prior art," in deciding whether to grant preliminary injunctive relief in a design patent infringement action. Id. at 942-43. Accordingly, to obtain any injunctive relief in this case, the plaintiff must submit documents that (1) specify which design patent(s) each defendant is accused of infringing, (2) analyze which ornamental components are shared between the accused product and the asserted design patent, and (3) analyze which of those shared features are not present in the prior art. This requires a product-by-product analysis. In other words, the plaintiff must provide, for each of the accused defendants' allegedly infringing products, an analysis of which components are shared or not shared with specified design patents as well as with the prior art. The plaintiff may file a renewed motion with the aforementioned showings and, if necessary, an amended complaint and schedule A, by 7/26/24. Failure to do so may result in dismissal of this case. A court may issue a preliminary injunction only on notice to adverse parties, Fed. R. Civ. P. 65(a)(1), and here the plaintiff has not adequately attested to its notification efforts. The plaintiff declares [85-1] that "[a]ll Defendants listed in this action and provided on Schedule A have been forward a [pertinent] link," and the returned summons 84 indicates that plaintiff's counsel "obtained contact information for defendants on Schedule A" and "served defendants via email." But neither piece of information identifies the specific email addresses (corresponding to the specific defendants) served. The plaintiff is afforded leave to file a declaration of serviceexpressly identifying which defendants have received proper servicealong with a renewed motion for a preliminary injunction. The Court declines to extend the TRO, which expires today, at this juncture. In extending the TRO 30 31, the Court (1) "cautioned" the plaintiff "to read orders carefully and comply with all deadlines set by the Court," and (2) specified that a motion for a preliminary injunction "must be served at least three business days prior to the [TRO's] expiration." MINUTE entry before the Honorable John J. Tharp, Jr: The Court is in receipt of the plaintiff's notices of voluntary dismissal 91 92 93 94 95 96 97 98 99 100 101. The plaintiff is advised that, for future notices of voluntary dismissals being filed contemporaneously, one consolidated notice should be filed rather than a separate notice for each defendant. Although the Court would ordinarily recognize the dismissal of each defendant listed by the plaintiff, the Court observes two issues with this most recent round of notices. First, some defendants that the plaintiff purports to dismiss at this juncture, including South City 93, have already been dismissed 46. Second, several numbers listed in the notices do not match the numbers appearing in the revised Schedule A. Homethrive is listed as defendant no. 117, for example 100, but appears on the revised Schedule A as defendant no. 157 20. On review of previous notices of voluntary dismissal, the Court has identified the same error. The plaintiff previously dismissed "Entasser (No. 139)" 35, for example, but Entasser appears on the revised Schedule A as defendant no. 185 24. The Court recognized the dismissal of defendant no. 139 49, but this defendant does not appear to be Entasser. The plaintiff is therefore directed, by 8/30/24, to file a list with the Court of defendants voluntarily dismissed from this action to date. Each entry in the list shall include the defendant's name and its correct number in the revised Schedule A 20 24. That said, the Court instructs the plaintiff to carefully follow its directions in the future, and it reserves the right to impose the penalty in docket entry 117 as a sanction for future noncompliance. Relatedly, the Court observes that docket entry 119 it is not, as ordered, a revised version of docket entry 115 "with correct 'defendant numbers' for all listed defendants" 117. Tharp, Jr: The Court has reviewed the plaintiff's two most recent notices of voluntary dismissal 130 131, which purport to dismiss AHABIPERS Deal LLC (defendant no. 111), MSCOCO Hair (defendant no. 16), and Tianshe Hair (defendant no. 23). The Court observes three issues. First, the plaintiff should have, consistent with the Court's prior instruction 103, filed "one consolidated notice" for these contemporaneously dismissed defendants. Second, and more importantly, the "defendant numbers" are once again incorrect. AHABIPERS is listed in the revised Schedule A 20 as defendant no. 144, not defendant no. 111. Similarly, MSCOCO is listed in the revised Schedule A 20 as defendant no. 9, not defendant no. 16. The plaintiff has "received filed copies" of the revised Schedule A, so possessing "slightly different" versions of the relevant documents no longer justifies the mismatch 120. Third, and perhaps most concerningly, the Court has already recognized the dismissal of defendant MSCOCO 116. The Court previously warned the plaintiff "not to re-list defendants whose dismissal the Court has already recognized" in future dismissal notices 121. It is evident that the plaintiff cannot keep track of the many defendants in this case. Accordingly, and consistent with the Court's reservation of "the right to impose the penalty in docket entry 117 as a sanction for future noncompliance," the Court dismisses all defendants except defendant nos. 6-8, 10-12, 16-17, and 23-24 (the ten lowest-numbered remaining defendants) from this suit without prejudice. For reference, those defendants are yujiekeji, Foni Shop, Ugrace Hair, Chomsi LLC, XUNY'S online, Donna Titan, JQNus-US, ShineTai, Tinashe Hair, and Star Show Hair 20. By 11/12/24, the plaintiff shall submit a new Schedule A in this case relabeling defendant nos. 6-8, 10-12, 16-17, and 23-24 as defendant nos. 1-10 (and listing only those defendants). If appropriate, the Court will recognize the dismissal of Tinashe Hair (upon renewed notice) after receiving the new Schedule A. The plaintiff may "refile new cases, with no more than ten defendants each, as to the dismissed defendants" 117. In so doing, the plaintiff must mark each new case as related to this matter so it is assigned to Judge Tharp. N.D. Ill. L.R. 40.3(b)(2). Because the TRO in this case has expired, and because the Court "may issue a preliminary injunction only on notice to adverse parties" 88, the Court will not entertain motions to seal or TRO motions (typical of newly filed Schedule A matters) in the new cases.
