MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for entry of a preliminary injunction [28] is denied without prejudice. The Court issued an ex parte temporary restraining order on 11/1/2024 and extended it on 11/13/2024. Both times the Court advised plaintiff that it had to promptly serve the defendants with summons via the electronic method(s) the Court had approved and advised defendant that if it waited until too close to the preliminary injunction hearing to serve the defendants the Court could deny entry of a preliminary injunction. Despite this it appears that the plaintiff waited until 11/22/2024--just 3 business days before the preliminary injunction hearing--to serve the defendants. The delay is not explained in the plaintiff's submission. The complaint describes the defendants as overseas entities. In the Court's view, three business days' notice of the filing of the complaint does not provide the defendants with sufficient time to defend against entry of a preliminary injunction. The motion is therefore denied without prejudice due to inadequate notice. Plaintiff seeks in the alternative a further extension of the temporary restraining order. But because plaintiff has made no effort to explain the delay in service of summons it has not in the Court's view shown good cause for a further extension. MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for reconsideration 87 is granted, in part. On summary judgment, defendants GUOJIJUYE Co. Ltd., HANCI Co. Ltd., and YUANYI Co. Ltd. did not oppose summary judgment on the issue of liability, and for this reason it was the Court's intention at the time to grant summary judgment for plaintiff on its claims on the issue of liability. It is so ordered. The Court respectfully disagrees, however, with plaintiff's contention that the amount of a statutory damages award may be determined on summary judgment. Even if the question of statutory damages involves undisputed or stipulated underlying facts, which may be the case here, the question of how the factors relevant to statutory damages are weighed (if nothing else) involves a matter that the Court does not believe it can appropriately adjudicate on summary judgment. The case therefore remains before Court for trial on the statutory damages amount. The Court agrees that attorney's fees are not an appropriate subject for a trial; these will be determined separately at or after the time the Court enters judgment on statutory damages.

MOTION by Plaintiff Hallmark Licensing, LLC to Extend Joint Status Report Deadline

MINUTE entry before the Honorable Matthew F. Kennelly: At the Court's instance, the telephonic status hearing set for 8/13/2025 is vacated and reset to 8/15/2025 at 9:15 AM, using call-in number 650-479-3207, access code 2305-915-8729. Motion to extend joint status report deadline 89 is granted, but the deadline is extended only to 8/14/2025. At the status hearing, the parties should be prepared to address whether the damages trial will be a jury trial or a bench trial, and to set a trial date. The Court has no problem conducting the damages trial in this case on a consolidated basis with the damages trial in Case NO. 25 C 1114 if that is what the parties propose. These topics should also be addressed in the joint status report filed on 8/14/2025.
