Nov. 14, 2024

MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's motion for entry of a TRO 14 is denied without prejudice. While the complaint 1, TRO memorandum 15, and proposed temporary restraining order reference 15 different copyrights, the screenshots in Exhibit 2 to the Declaration of Jennifer Megan Budrock 16 only demonstrate infringement as to two. What is more, the screenshots do not show any defendants infringing multiple copyrights, raising a question as to the propriety of joinder. Plaintiff may submit a renewed motion (and, if needed, an amended complaint) that addresses or moots these issues by 12/2/24. If the renewed motion contains new or different screenshots, it must be accompanied by a new certification regarding screenshot evidence 17. It must also be accompanied by an index that (1) matches each defendant to the screenshots supplied in support of the motion, (2) lists the dates those screenshots were taken, and (3) identifies, on a defendant-by-defendant basis, the specific copyright(s) each defendant has allegedly infringed.
