SEALED EXHIBIT by Plaintiff Mark Missman Sealed Exhibit 2, Declaration of Mark Missman regarding memorandum in support of motion, 14

16

Aug. 14, 2025

MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for leave to file under seal 11 and motion for leave to file excess pages 12 are granted. Plaintiff's motion for entry of a temporary restraining order and for electronic service 13 is denied, without prejudice to refiling. In the Court's view, sending an email with a link to a website where the relevant papers may be found is insufficient; the service must include the relevant materials (summons, complaint, etc.) as attachments to the email so that they are actually sent to the defendant granted. If and when plaintiff refiles the motion, the draft order will need to be revised and resubmitted accordingly.

Aug. 27, 2025

MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for extension of the temporary restraining order 24 is granted; the ex parte TRO entered by the Court on 8/18/2025 is extended through 9/19/2025 (the Court will be unavailable through 9/15/2025). The telephonic preliminary injunction hearing set for 9/2/2025 is vacated and reset to 9/19/2025 at 8:50 AM. The following call-in number will be used for the hearing: 650-479-3207; access code 2305-915-8729. Motion for preliminary injunction must be filed by 9/15/2025. Plaintiff is reminded that the Court may deny entry of a preliminary injunction if there is an insufficient interval between service of summons and the preliminary injunction hearing.
