NOTICE of Motion by Justin R. Gaudio for presentment of motion for leave to file[3] before Honorable John Robert Blakey on 9/3/2025 at 11:00 AM. |

MINUTE entry before the Honorable John Robert Blakey: Plaintiff initially filed a complaint seeking to sue 73 separate defendants in this single trademark infringement suit, see [1], [2]. Once the case was reassigned to this Court, however, Plaintiff filed an amended complaint and an amended Schedule A, which lists just one Defendant, and thus attempts to avoid any joinder issues, see [11], [12]. Although the amended Schedule A lists just one defendant, the amended complaint itself remains drafted as if it still targets multiple defendants. Given the disconnect and ambiguity, the Court dismisses Plaintiff's amended complaint [11]; if Plaintiff wishes to proceed, it must conform its allegations to the current Schedule A. The Court grants Plaintiff's motion for leave to file under seal [3] and strikes the 9/3/25 Notice of Motion date. Mailed notice. |
