MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion to file under seal 4 is granted. Ruling on plaintiff's motion for entry of a temporary restraining order and motion for electronic service is deferred. Based on the Court's review of the complaint and TRO materials, it does not appear that plaintiff has any evidence of actual sales by any defendant into Illinois or even one step short of that, a confirmed sale contemplating product delivery into Illinois. The Court therefore questions the existence of personal jurisdiction over the defendants. Plaintiff is directed to file by 11/12/2025 a memorandum, supported by declarations and other evidence, showing any actual or confirmed sales contemplating delivery into Illinois, on a defendant-by-defendant basis, as well as any argument supporting the existence of personal jurisdiction in Illinois over each of the named defendants. A telephonic status hearing is set for 11/19/2025 at 9:10 AM, using call-in number 650-479-3207, access code 2305-915-8729. |
